These Terms & Conditions (“Terms”) govern your access to and use of the Groceries Care mobile app and website (the “Service”) operated by Groceries Care PVT LTD (“Groceries Care,” “we,” “us,” or “our”). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2) Eligibility & account

  • You must be legally capable of forming a binding contract and (if applicable) at least the age of majority in your jurisdiction.
  • You are responsible for safeguarding your account credentials and all activity under your account. Notify us immediately of any unauthorized use.

3) Service scope

We provide a quick-commerce grocery ordering and delivery service within specified delivery areas and time windows. Availability, assortment, and delivery slots may vary.

4) Orders, pricing & availability

  • Placing an order is an offer to buy the items listed; we may accept or reject any order at our discretion (e.g., out-of-stock, address outside coverage).
  • Prices, discounts, fees, and taxes may change at any time before order acceptance. Obvious pricing errors are not binding.
  • Images are illustrative; actual packaging/weight may vary. We may propose item substitutions if you enable substitutions.

5) Payment – Cash on Delivery (COD)

  • We currently accept Cash on Delivery only. Please prepare exact cash or follow the rider’s instructions for settlement at handover.
  • Title and risk for items pass to you upon successful delivery and payment.

6) Delivery, delays & access

  • Delivery windows are estimates and may be affected by traffic, weather, or inventory.
  • You must be available to receive the order at the provided address and time. If we cannot deliver due to your unavailability or restricted access, a redelivery or cancellation fee may apply (if disclosed at checkout).
  • We may require an OTP/phone confirmation at handover for fraud prevention.

7) Quality, returns & refunds (groceries)

  • Inspect items at delivery. For perishable goods, claims for damage/quality issues should be reported at delivery or within 24 hours with photos and the order ID.
  • For hygiene/safety reasons, we generally cannot accept returns of opened/perishable items unless defective or delivered in error.
  • Approved refunds (full/partial) or replacements will be processed via store credit or redelivery (no online refunds since COD). Specific remedies depend on product type and evidence provided.

8) Substitutions & out-of-stock

If you enable substitutions, we may replace an out-of-stock item with a comparable product at equal or lower price. You can decline substitutions in-app/at checkout. If you decline and no item is available, that line item will be cancelled.

9) Promotions, vouchers & credits

Promo codes, vouchers, and credits are single-use, non-transferable, and may have expiry, area, or minimum order restrictions. We may modify or withdraw promotions at any time as permitted by law.

10) Acceptable use

You agree not to use the Service unlawfully, interfere with the Service (including scraping or bot abuse), or post harmful or infringing content. We may suspend or terminate accounts that violate these Terms.

11) User content & feedback

If you submit ratings, reviews, or feedback, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for Service operation and improvement. Do not submit content you do not have the right to share.

12) Intellectual property

The Service (including text, graphics, logos, and software) is owned by or licensed to Groceries Care and protected by applicable IP laws. You receive a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes.

13) Third-party services & links

The Service may link to third-party websites/services. We are not responsible for their content or practices. Use them at your own risk under their terms.

14) Privacy

Your use of the Service is also governed by our Privacy Policy (COD-only; no online payments).

15) App permissions & devices

  • Location (optional): delivery areas/ETAs
  • Notifications: order updates
  • Camera/Photos (optional): return images or proof of delivery

You can disable permissions in device settings; some features may not work without them. You are responsible for data charges and ensuring your device/OS is compatible.

16) Service changes & maintenance

We may modify, suspend, or discontinue any feature or part of the Service with or without notice, subject to applicable law.

17) Disclaimer of warranties

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

18) Limitation of liability

To the fullest extent permitted by law, Groceries Care will not be liable for indirect or consequential damages or for lost profits/data arising from your use of the Service. Our aggregate liability will not exceed the amount you paid to us for the order giving rise to the claim (if any).

19) Indemnity

You agree to indemnify and hold Groceries Care harmless from claims and costs arising from your breach of these Terms or misuse of the Service.

20) Governing law & disputes

These Terms are governed by the laws of Nepal. Disputes will be attempted to be resolved amicably within 30 days of written notice; otherwise, they may be submitted to competent courts in Kathmandu, Nepal, unless mandatory consumer laws provide otherwise.

21) Suspension & termination

We may suspend or terminate your access if you violate these Terms, misuse the Service, or if required by law. You may terminate at any time by deleting your account (if available) and ceasing use.

22) Changes to Terms

We may update these Terms from time to time. We will update the “Last updated” date above and may notify you via app/website/email for material changes. Continued use means you accept the revised Terms.
